Topeka domestic abuse survivor trembling over DA's decision

16 years after enduring constant physical abuse, the memories still shake Claudine Dombrowski to the core. She says, "I was beaten with a crowbar, it was a misdemeanor. I've had both my wrist broken and it was a misdemeanor."
When Shawnee County District Attorney Chad Taylor decided to hand over misdemeanor cases, like Dombrowski's, to the city, she knew it would weigh heaviest on victims of domestic violence. Knowing the consequences a victim could face when the abuser is arrested, then released, she advises victims not to call the police. She says, "You, as a survivor, know how to survive. You just keep surviving. If you call the police right now, and God forbid you end up with the city, you might die."
Dombrowski says she's disgusted at how poorly survivors are treated after making the terrifying decision to call authorities. She says community leaders see it as, "Let's put these victims in with weed control and dog at large and parking tickets. That's how important you are to our community."
Dombrowski says the word "misdemeanor" has such a harmless connotation and wishes people knew the horrible actions hiding behind it. She says, "I was pushed through plate glass windows and if I had not been in a relationship with this man, he would be in prison."
If the city does decide to take on the domestic abuse cases, Dombrowski hopes it's only until funding can be restored at the District Attorney's office. She says, "We've just jumped back 30 years into the dark ages, and it's very dark. The lights just went out in Topeka."
She says many times the misdemeanor charges get reduced to disorderly conduct and destruction of personal property, and she can't imagine how easy the abusers will have it in city courts. Dowbrowski says you can help domestic violence victims of Topeka by demanding more money for the District Attorney's office, so they can continue to protect the public.

UPDATE:
Wednesday morning, Topeka Interim City Manager Dan Stanley said there is some thought being given to repealing the city ordinances to force the prosecution back on the county. He says it will then be up to the D.A. to prioritize what cases should be prosecuted.
Stanley says he's concerned about what will happen to the individuals whose cases are not being prosecuted. He says, "We know of three cases where judges have released the people accused of domestic violence back out because it their understanding that the district attorney will not prosecute and so there may be more of these."
Topeka Police Officers are forwarding misdemeanor cases involving domestic violence to the District Attorney's Office. Stanley says the D.A.'s office has already turned away 30 cases. He believes the  victims and their families are most affected.

OMGOSH--so many great comments that have been stated already-- I have to agree with most all of them--Claudine I applaud you as I have always done in the 7 yrs that we have known each other--I know how hard it is to get up & tell your story--especially when both the perp & his buddies & many times the law enforcement are standing there going oh yea-she’s a victim & then laughs, scoffs or whatever & then does not help us or come to our aid--my perp has the blessings of his judge, atty & prosecutor friends & has told everyone that I am crazy, a liar & more--it is so hard to have a life when this is what you have to deal with--yes I know that life is not fair--but come on this is not even close! ALL of them should be in jail for victimizing the victims & not helping them. I really wonder how the VAWA(violence against women act) is going to be upheld in Topeka-& Kansas to be a federal law--& they do not want to follow the federal laws--is that right--I do not think so--I am kind of curious--it seems from what I have read--seen that perp of animal abuse/cruelty get stiffer penalties then those for domestic violence--what are we then--women & children are treated lower then these animals--I don’t want animals treated poorly- just we should be treated in a higher way then they-- my perp tried to run me over--& zippo--he knew the prosecutor- he still threatens me today & I still live in fear--most of the time--yes hard to live this way--you bet— because he lied to the court—REPEATEDLY so as far as I am concerned he is stealing from me continually- & if I am not mistaken the amount is way over a felony charge--but the authorities will not do anything to their friend-- THE GOOD OLE BOY SYSTEM- NEEDS TO BE THROWNOUT & WE NEED TO BE THERE & PROTECT THE VICTIMS OF THIS VIOLENCE JUST BECAUSE WE 'THOUGHT WE LOVED THEM" & HAD AN INTIMATE RELATIONSHIP WITH THEM WE HAD NO WAY TO KNOW WE WOULD BE TREATED LIKE THIS, SO PUNISH US MORE? Live yes how can I? I live in fear of him daily!

Its sad to hear about cases like these occurring. Its obvious that there is a great deal of corruption that led to people losing touch with what is the "right thing to do" and chose the lower option for the sake of a cheap thrill. I hope that the light keeps shining on these cases and something more solid is done not only for those who are about to experience it, but for those who have endured this for so long. They deserve justice. Just because these women have less of a voice in society, does not mean we should ignore them. To do so is a crime within itself.

I am literally beside myself with disbelief that such horror occurs at such frequency to women. I am beyond angry that no one is prosecuting the most vicious crimes called 'domestic violence.' There is nothing domestic about terrorism. A Woman will never be free of violence until she is allowed to leave the abuser with her children and the crimes committed against her are charged, prosecuted and sentenced with sever sanctions. All the Governmental entities that created an already over burdened system and with minimal to non effective consequences for violence against women should be fired. Maybe this is chance for Topeka to get up to speed on updated research and start being the change, it's pretty simple really, LET BATTERED MOTHERS LEAVE THE ABUSER WITH THEIR CHILDREN. Stop spending county/city/state/federal money to 'fix' the abuser! His Rights His, his his his his..... When will victims rights ever begin to 'trump' the perpetrators rights? I rest my case.

Kansas is Middle-America. To let abusers (predominantly men) get away with hurting women, children, and animals (a key indicator of an abuser) is UN-American....As a patriotic American MAN, I am appalled at the idea that abused women are turned away from the DA's purview. We are supposed to protect all citizens, especially those we love. These abusive men are a travesty to America and should be hung by their offending parts, be it hands, feet, or other organ. Thank you for writing this article. Not all men are like this (abusive). A real man lifts women and children up.

I was a victim of domestic violence once. If you look at the statistics on the occurence of domestic violence it is quite high. They seem to argue between one in 4 and one in 5 women will be abused in their lifetime. Since it has already happened to me, and I have daughters, I will be moving out of Kansas. Punishments are supposed to work as a preventative measure, to stop criminals from doing the crime. A few months in community service in an area where these folks will meet more victims sounds more like an enabling action to me. If me and my daughters hold this miniscule value as human beings in Kansas, we are out! Talking to a realtor today!

Google Barry Goldstein, Lundy Bancroft, the Batterer as Parent we have past the injustice of prosecution alone but the system REWARDS bad behavior. Google "family Courts helping batterers get custody of children'. By nicking the crimes in the beginning, calling them crimes making them crimes against women then we can stop the same from happening to women in family court when they leave the abuser who currently are being told to jump out of the frying pan and into the fire. Oh and why do we ALWAYS blame the victim? and what is a respected victim? There is no such thing. A victim is a victim,PERIOD, she did does not have to defend herself it is the batterer who should be ashamed and is not, will not be until there are REAL Consequences for HIS crimes against HER. That means no more coddling, no intervention, no anger management. You can not fix these evil cruel mean torturous people, they need locked up, shot, hung from the highest tree. But alas, they get attorneys who get them off, and of course the attorneys get lots of money, hmmmm sounds like we need to take the 'profit' out of being a batterer and a batterers attorneys, shrinks etc.... Accountability for all of them. The System, the batterer and those who profit by assisting the batterer! The crookedness and back door dealings, the profitability of the DV Industry. Use some common sense, quit protecting abusers and start protecting the women and children who are victimized- 1,900 case a year run through Shawnee County Court. That's a lot of injustice, err I mean 'ju$t-u$' $$$$

It gets even worst than just the failure to prosecute the most heinous crimes of Family Violence. But even with a history of Domestic Violence, the batterer can and will take custody of the children if she dares to leave him. In a 2007 Docking Report in Kansas this was listed as the number one reason that DV went unreported in Kansas. We really need more than just continued prosecution. We tell women to leave, we tell them that they do not have to live in fear, but when they do get the strength to leave the same system that tells them to leave helps to punish them by taking their children and giving them to the abuser. in 97% of 'high conflict' divorce case (all of which have a history of abuse) the batterer gets custody of the children. There is solid research supporting this. In family court when the woman does leave, the abusers, criminal history is disallowed in the visitation and custody of the children. The next best thing to killing the woman is to take her children. The whole system is aware of this yet no one is changing it, God forbid we step on the criminals rights to owner ship of his wife and HER children. It is easy enough to see that this alone is extremely abusive, extremely damaging to the mother and extremely damaging to the children who are forced to live with the abuser and denied all contact with the mother who 'did the right thing' and left the abuser, only to find herself in a system, that does not give a crap for her rights, only the rights of the criminal. Bully's and narcissist's understand only one thing, the same as what they do. All family violence should be a felony, none should ever be reduced to non person injury, like they all are, and an abuser should NEVER have access to the children so that he can continue to control, abuse and torture that woman for leaving him. We have come a long way, but we have yet to even begin to ensure the human rights of battered women.
